The Legal Situation

Josh Jacobs recently spent the night in the Brown County Jail after allegations of domestic abuse surfaced from a May 23rd incident. Jacobs was released after one night in jail, however, and the District Attorney has declined to file charges against the Green Bay running back. Does this mean he's in the clear? Not quite.

The statement from the Brown County District Attorney's office regarding the allegations notes that, while charges have not yet been filed, an ongoing investigation is examining what may have occurred and whether charges are appropriate. The process seems confusing because Wisconsin's laws differ from those in some other states. They have a mandatory-arrest policy on the books that requires law enforcement to make an arrest in this type of case. That doesn't bind the District Attorney to the allegations from the police agency, however, and they've made that clear in their statement.

Jacobs, through his attorneys, has maintained his innocence since this became public, and they issued a statement today saying they believe charges will not be filed once the investigation is complete.

What do you do with Jacobs for fantasy purposes right now?

The problem for fantasy managers at this point is that there are no definitive answers that provide a clear route to follow. The best path, however, should properly reflect the amount of risk Jacobs currently carries with these allegations hanging out there.

Unfortunately, the legal process does not have a definite timeline for its conclusion. This means that the resolution could come next week or in two months. Chances are strong, though, that the issue will be resolved before the NFL season, likely before training camp starts. That means for redraft purposes, fantasy managers should know what to do by the time peak redraft season hits in late July and into August.

If fantasy managers are drafting now, playing best ball, or involved in dynasty trades, the best way to describe Jacobs' situation is cautious optimism. Even before the District Attorney's statement, it was no lock that Jacobs would be suspended this year. Even if charges were filed, the timeline of the case would be too long to impact 2026 because the NFL usually likes to let the legal process play out before handing down suspensions. The Commissioner Exempt list is still a possibility, but given the uncertainty around this case, it doesn't have a high probability. Instead, if charges are declined, he'll likely avoid suspension; if they are filed, there is a good chance the case won't be resolved until the 2027 offseason.

This presents a potential buy-low opportunity for dynasty managers, as long as they recognize that the situation still carries healthy risk. Making a move to acquire Jacobs can pay dividends by playing off the general hysteria and pessimism that comes with these serious allegations. But, trading on the margins like that only works if managers understand what Jacobs is facing, and what he is facing is quite serious. Buyer beware.

Conclusion

Josh Jacobs is a volatile fantasy asset right now. But if a fantasy manager wants to acquire or draft Jacobs, it's reasonable to think that Jacobs either escapes charges altogether or any suspension will be delayed until 2027 or beyond while the legal process plays out. The situation is risky, but not untenable. As long as fantasy drafters understand the gamble they're taking, Jacobs still appears poised to have 2026 fantasy viability.
